OlyAdmit Terms of Service
Effective Date: August 2, 2026
Welcome to OlyAdmit. These Terms of Service govern your use of the OlyAdmit platform, including but not limited to our Atlas, Athena, Chronos, and other AI-powered tools and scholarship systems, provided by OlyAdmit LLC (operating under the "OlyAdmit" brand name, and referred to herein as "OlyAdmit," "we," "us," or "our"). By creating an account or using our services, you agree to be bound by this agreement. Account creation also requires separate acceptance of the Privacy Policy and separate consent to AI data processing, and all three together govern your relationship with the platform.
Scope of Terms: These Terms apply strictly to student users of the OlyAdmit platform. School and counselor access to the platform is governed by a separate set of terms and conditions. Your use of the platform is also governed by our Privacy Policy.
1. Eligibility, Age Verification, and Account Security
1.1 Age Verification & Misrepresentation
You must be at least 13 years of age to use OlyAdmit. The service is strictly not directed to children under 13. During registration, users are required to confirm their age by providing their month and year of birth and completing any required system verification steps.
Mandatory Verification & Device Fingerprinting: To maintain platform security and data integrity, the verification workflow enforces strict technical limits. If a user fails the initial age gate (the month and year input), device fingerprinting is used to apply a technical block to that device for seventy-two (72) hours to prevent repeat attempts. For users progressing to account creation, a maximum of three (3) verification or capture attempts are permitted per registration session; if a session fails, users may initiate up to two (2) additional retry sessions (for a maximum of three (3) total sessions); and each registration session will automatically expire seventy-two (72) hours after initiation. If a user explicitly indicates they are under 13, account creation is immediately blocked and no personal information is collected or stored. If a user is flagged for additional identity verification and fails or does not complete the verification process, the user profile and authentication record are immediately deleted, and this verification step cannot be skipped. If an account is suspended pending age verification and the process remains unresolved or incomplete, the account and all associated data are automatically deleted after seventy-two (72) hours. Providing false age information to circumvent these protections constitutes a material breach of these Terms and will result in the immediate termination of your account.
Voluntary Verification: Separately from the mandatory verification flow, the platform offers an opt-in, voluntary age verification option accessible from the profile page. For users who are not flagged for mandatory review, this voluntary process is entirely non-punitive. There are no retry limits, no permanent device blocks, and no account deletions if a voluntary verification attempt fails.
1.2 Acceptance by Minors
If you are between 13 and 18 years old, you represent and warrant that you have the capacity to understand and accept these Terms on your own behalf.
1.3 Account Security & Session Policies
OlyAdmit is an entirely passwordless platform. Authentication is handled via Google OAuth, Discord OAuth, and email magic links. There are no OlyAdmit-specific passwords to safeguard; therefore, you are solely responsible for securing access to your linked email accounts and OAuth providers. You agree to notify OlyAdmit immediately at privacy@olyadmit.org if you become aware of any unauthorized access to or use of your account. OlyAdmit shall not be liable for any loss or damage arising from your failure to safeguard access to your underlying email or OAuth accounts.
Session Timeouts: To maintain our age-differentiated security architecture, user sessions are subject to automatic expiration:
- Minors (ages 13–17): Sessions expire after 24 hours of active use or 30 minutes of idle time.
- Adults (ages 18+): Sessions expire after 7 days of active use or 1 hour of idle time.
2. Acceptable Use and Platform Conduct
2.1 Academic Integrity
OlyAdmit is designed to act as a counselor, editor, and brainstorming partner. You agree not to use our services to violate the academic integrity policies of any high school, college, or university. Specifically, you may not use the platform to submit AI-generated text entirely as your own where prohibited, fabricate credentials or extracurricular activities, plagiarize content, or engage in any fraudulent activity regarding your college applications.
2.2 Prohibited Conduct and Content Standards
You agree not to engage in any unlawful use of the platform, attempt unauthorized access to our systems, or intentionally disrupt the service. You may not scrape, crawl, or extract data from the platform by automated means, nor may you impersonate any other person or entity. You further agree not to submit any content that is threatening, harassing, abusive, discriminatory, or otherwise harmful. OlyAdmit actively utilizes automated content moderation and safety systems and reserves the right to restrict or terminate your access to the service if your submissions violate these safety standards.
3. Intellectual Property and Licenses
3.1 User Ownership
You retain full intellectual property ownership of all original materials (essays, inputs, prompts) you submit to the service. OlyAdmit claims no ownership over the text generated by the AI models in response to your prompts.
3.2 License to OlyAdmit
By submitting content, you grant OlyAdmit a limited, non-exclusive, royalty-free license to process, transmit, and temporarily store your materials solely to the extent necessary to provide the Service to you. This license terminates upon deletion of your account.
3.3 Platform Ownership
OlyAdmit retains all rights, title, and interest in and to the platform's software, source code, user interfaces, and proprietary AI agent architectures ("Proprietary Information"). You agree not to reverse-engineer, decompile, or extract components of the platform for any competitive or commercial purpose.
3.4 Feedback and Suggestions
If you voluntarily provide OlyAdmit with any feedback, suggestions, or ideas regarding the platform, you grant us a perpetual, unrestricted, worldwide, royalty-free license to use, modify, and incorporate such feedback into our services without any obligation or compensation to you.
4. Counselor Integration (Opt-In)
If you choose to link your account with a school counselor by entering a specific "Counselor Code," you participate in a three-tier data sharing model based on your preferences. Furthermore, counselors with appropriate access can review and leave comments directly on your essays, and the platform will track and save these essay versions.
- Limited View: High-level progress metrics and milestone completion data are automatically shared with your linked counselor.
- Mixed View: Selected sensitive content, such as specific draft essays, is shared alongside your progress metrics when explicitly initiated by you.
- Full View: Complete visibility into your profile and materials is granted to the counselor.
- Revocation: You may revoke or downgrade a counselor's access tier at any time. Once revoked, no new data will be shared. However, OlyAdmit cannot retrieve or force the deletion of data or reports the counselor may have already exported or saved to their own external records prior to revocation. Please note that counselor data access is further governed by separate counselor terms.
5. Fees and Future Paid Features
The student-facing OlyAdmit platform is currently provided entirely free of charge. There are no billing cycles or financial obligations applicable to your account. If premium features are introduced in the future, they will be subject to clear, separate, opt-in financial terms.
6. Service Limitations and Disclaimers
6.1 No Guarantee of Admission
OlyAdmit provides guidance based on historical data and AI models. We do not and cannot guarantee admission or scholarship awards to any specific institution or program.
6.2 AI Limitations
The content generated by our AI models may contain errors, inaccuracies, or hallucinations. You are solely responsible for reviewing, verifying, and refining all application materials before submitting them to any institution.
6.3 "As-Is" Provision
OlyAdmit uses commercially reasonable efforts to maintain platform stability. However, the service is provided "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OLYADMIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
6.4 Not a Crisis Intervention Service
OlyAdmit is an educational tool, not a health, safety, or mental health monitoring service. Our platform and AI agents are not designed to provide medical advice, psychological counseling, or crisis intervention. While the platform does utilize automated crisis content detection across all chat and essay pathways to deliver immediate crisis resources when triggered, this automated system is not a substitute for professional crisis services and does not involve human review. User inputs are not monitored by human staff in real time. If you or someone you know is experiencing a mental health emergency, please contact emergency services (such as 911) or a dedicated crisis hotline (such as the 988 Suicide & Crisis Lifeline) immediately.
6.5 Third-Party Services
The platform may contain links to or integrate with third-party services (such as Didit for identity verification or external health and crisis resources). OlyAdmit does not endorse and is not responsible or liable for the availability, accuracy, or content of these third-party services.
7. Termination and Survival
7.1 By User
You may terminate your account at any time through your profile settings. Upon termination, all active personal data, chat histories, and essays will be immediately and permanently deleted from production databases in accordance with our Privacy Policy. However, please note:
- Backup Retention: Your production data will persist in encrypted system backups for up to ninety (90) days until it is overwritten through our standard, automated backup cycle.
- Audit Record: A compliance record of your account deletion is retained in a secure audit log (deleted_accounts_audit) for twelve (12) months on a rolling basis to satisfy GDPR and COPPA documentation requirements, after which it is securely deleted.
7.2 By OlyAdmit
OlyAdmit reserves the right to suspend or terminate your account and access to the platform immediately and without notice if you breach any material provision of these Terms. Additionally, as outlined in Section 1.1, accounts suspended pending age verification that remain unresolved will be automatically deleted after seventy-two (72) hours. In the event of termination by OlyAdmit, your data will similarly be subject to the deletion protocols outlined in our Privacy Policy.
7.3 Survival
Upon termination, the provisions relating to Acceptable Use, Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, and Force Majeure shall survive and remain in full effect.
8. Limitation of Liability and Indemnification
8.1 Limitation of Liability
To the maximum extent permitted by law, OlyAdmit shall not be liable for any indirect, incidental, special, consequential, or punitive damages. EXCEPT IN CASES OF PROVEN GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OLYADMIT'S TOTAL CUMULATIVE LIABILITY FOR DIRECT DAMAGES UNDER THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100.00) OR THE TOTAL AMOUNTS PAID BY YOU TO OLYADMIT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8.2 Indemnification
If you are 18 years of age or older, you agree to defend, indemnify, and hold harmless OlyAdmit from any claims, damages, or reasonable attorneys' fees resulting from your violation of these Terms, violation of applicable law, or breach of academic integrity policies. (Users under the age of 18 are not subject to this indemnification obligation.)
9. Force Majeure
OlyAdmit shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by events beyond our reasonable control. This includes, but is not limited to, Acts of God, pandemics, government actions, power or internet outages, cyberattacks, labor disputes, or the failure of third-party infrastructure and service providers. Obligations are suspended for the duration of the event.
10. Governing Law, Dispute Resolution, and General Terms
10.1 Governing Law
These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of law provisions.
10.2 Dispute Resolution & Arbitration
Any disputes arising from these terms shall be resolved exclusively through binding arbitration in accordance with the Consumer Arbitration Rules of the American Arbitration Association (AAA), provided that either party may bring qualifying claims in small claims court. For claims brought by consumers, OlyAdmit will cover all AAA filing, administrative, and arbitrator fees beyond what the consumer would typically pay to file a claim in small claims court. To ensure accessibility, any arbitration hearings may be conducted remotely (via telephone or video conference) at your election.
The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability, or formation of these Terms, including but not limited to any claim that all or any part of these Terms is void or voidable (such as claims based on a user's status as a minor). All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member. Please note: The enforceability of arbitration agreements involving minors may vary under applicable state law.
10.3 Arbitration Opt-Out
You may opt-out of this arbitration agreement within 30 days of first accepting these terms by emailing privacy@olyadmit.org. Your notice must include your full name, the email address associated with your account, and a clear statement indicating your desire to opt out of arbitration.
10.4 Modifications
We may update these Terms from time to time. We will notify you of material changes by email or platform notice at least thirty (30) days before the changes take effect. If you disagree with the modified Terms, you have the right to terminate your account before the effective date. Continued use of the platform after the effective date constitutes acceptance.
10.5 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. OlyAdmit may freely assign its rights and obligations, including in connection with a merger, acquisition, or asset sale.
10.6 Waiver
The failure of OlyAdmit to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
10.7 Severability & Entire Agreement
If any provision is found to be unenforceable, the remaining provisions will continue in full force. These Terms, together with the Privacy Policy and the separate consent to AI data processing, constitute the entire agreement between you and OlyAdmit regarding the platform.
10.8 Electronic Communications Consent
By creating an account, you consent to receive communications from us electronically (via email or platform notices). You agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.
